Fighting For Fairness, Inc. (referred to in this policy as “Fighting For Fairness,” “we,” “our” or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Notice.  This Privacy Notice describes how we collect, use, protect and disclose information collected about individuals located in the United States (referred to in this policy as “you” or the “user”) who visit and engage with us through our website, located at https://fightingforfairness.org, as well as our branded pages on social media services (collectively, the “Site”).  This Privacy Notice also applies with respect to information collected when you apply to and/or participate in (“Participate”) our scholarship, counseling or mentorship programs in connection with the law school application and admissions process (the “Fellowship Program”).

We encourage you to read this Privacy Notice in its entirety, as it applies to your access and use of the Site and, if applicable, Participation in the Fellowship Program, and is incorporated into and is subject to our Terms of Use (the “Terms”).  By using the Site or Participating in our Fellowship Program, you consent to the privacy practices described in this Privacy NoticeIf you do not agree with the terms of this Privacy Notice, please do not use the Site or Participate in the Fellowship Program.

What Categories of Personal Information Do We Collect?

Fighting For Fairness collects, processes and maintains several types of information, certain of which may constitute Personal Information, from and about users of our Site and our law student fellows who apply for and are selected to take part in the Fellowship Program (such law students, “Fellows”). “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular person, but does not include any information that is publicly available or that is aggregated or de-identified.  

The type of Personal Information we collect depends on how you choose to interact with our Site, including whether you Participate in our Fellowship Program. For instance, if you choose to donate to our Site, we will need different information than if you Participate in our Fellowship Program or simply visit our Site for informational or educational purposes. As a general matter and in connection with your use of our Site or your Participation in, our Fellowship Program, we may collect the following categories of Personal Information about you, only when you voluntarily choose to provide them to us, including: 

  • Identifiers, such as your name, physical and/or mailing address, email address and mobile or other telephone number, your Law School Admissions Council (“LSAC”) number or other similar identifiers;
  • Professional or employment-related information submitted in connection with your application to the Fellowship Program (“Fellowship Application”), such as your education and work history, transcript related information and information related to your law school application;
  • Financial information submitted in connection with your Fellowship Application, such as your LSAC fee waiver or tax returns, or when you make a donation as further described below, such as payment method, payment card number, expiration date, authorization number or security code and billing address;
  • Characteristics about protected classes, such as your residency and/or citizenship status;
  • Social media account information, such as username and website; and
  • Any other Personal Information provided by you in connection with the Fellowship Program, including information that you submit in connection with your Fellowship Application such as photographs and information contained in your essay responses.

Additionally, we may automatically collect certain information about you through online technologies when you visit our Site that may also constitute Personal Information; such information may include:

  • General activity information as part of our and our third-party service provider’s fraud-prevention programs;
  • IP address;
  • The type of browser, operating system or equipment used to access the Site and
  • Usage details, such as the date and time you visited the Site, the Internet address of the site from which you linked to the Site, the links you follow from the Site (including to our Donations Processor (as defined below)), and the reading history and other analytics related to how you use and view the content we have provided via the Site.

From What Sources Do We Collect Personal Information? 

Information you provide:

We collect the Personal Information you voluntarily choose to provide, such as when you fill out forms or fields on the Site, when you submit a Fellowship Application to participate in the Fellowship Program, when you make a donation, and when you contact us or request information about us, this Site or the Fellowship Program (whether by email or other means).

As further described below in the section titled “Information Collected From and About Our Donors”, we may request and receive certain of your Personal Information, including your financial information, from our Donations Processor for purposes of completing transactions or protecting against or identifying possible fraudulent transactions.

Information we automatically collect:

When you visit the Site, or use a third-party website that interacts with our Site, including our Donations Processor, we may automatically receive and record certain information from your computer, web browser or mobile device that may qualify as Personal Information as further described above.  For example, when you use the Site, we may send one or more cookies (which are small text files containing a string of alphanumeric characters) to your computer or mobile device, to recognize your web browser, help analyze our web page flow, customize our content, measure promotional effectiveness and promote trust and safety. Specifically, we use certain cookies placed by SquareSpace to collect and analyze information about the use of our Site and to report on activities and trends.  This service may also collect information regarding your use of other websites, apps, and online resources.  You can learn about SquareSpace’s practices by going to https://support.squarespace.com/hc/en-us/articles/360001264507-The-cookies-Squarespace-uses.

Please note that if your browser permits, you may configure your browser to refuse or delete cookies, or to alert you when cookies are being sent. Please consult the corresponding instructions of the manufacturer for more detailed information on the actual procedure. If you choose to turn off cookies, however, some parts of the Site may not function properly. Even if you block or delete cookies, not all of the tracking that we have described in this Privacy Notice will stop.

Do Not Track Disclosure. Third parties such as advertising networks, analytics providers and widget providers may collect information, including Personal Information, about your online activities over time and across different websites when you access or use our services.  Currently, various browsers offer a “Do Not Track” option, but there is no standard for how “Do Not Track” should work on commercial websites.  Due to lack of such standards, the Site does not respond to Do Not Track consumer browser settings.  

Information Collected From and About Our Donors

In addition to the Personal Information described above, we may collect additional Personal Information from individuals who donate to our initiatives through the Site (“Donors”).  Such information may include giving information, including types and amounts of donation, financial account and related information, such as payment method, payment card number, expiration date and authorization number or security code and billing address, collected and stored through our third-party Donations Processor. 

In addition to the uses of Personal Information set out below in the section titled “How We Use the Information We Collect,” we use such information collected from Donors to process donations, issue tax receipts and analyze giving patterns. 

All information about any financial and non-financial transactions between Donors and Fighting For Fairness is considered highly confidential, and we employ security measures designed to protect it. While the information is kept confidential, it may be shared within our organization, with volunteers or with other external advisors or professionals on a need-to-know basis and in compliance with all applicable laws, regulations, court orders, or other governmental requests.

Online donations to Fighting For Fairness are facilitated by our non-affiliated donations processor, Donorbox (“Donations Processor”). If you choose to make a donation, you will be linked to our Donation Providers’ website, which is subject to separate a privacy policy and terms and conditions, and is made available via “framing technology,” and therefore may appear to be a part of our Site.  We urge you to familiarize yourself with the individual terms of each linked or framed site available on our Site prior to submitting any Personal Information.  We are not responsible for the data collection, privacy and information sharing policies and procedures or the content of such websites.

How Do We Use the Information We Collect?

We may use the Personal Information we collect for the following purposes:

  • To process your Fellowship Application;
  • To facilitate the Fellowship Program, including to provide Fellows with law school admissions counseling, career counseling or mentorship services;
  • To provide you with the information or resources that you request from us; 
  • To process donations and issue tax receipts;
  • To learn about our Donors and analyze giving patterns;
  • For administrative purposes, such as to notify you of other communications that might be of interest to you and of future giving campaigns; or
  • For any other purpose for which we have your express consent.

Additionally, we may use non-identifying information (including aggregated data) about your use of the Site to understand and analyze the usage trends and preferences of our users, to monitor, analyze the effectiveness of or otherwise improve the Site or the Fellowship Program and to facilitate or improve fraud detection and information security.

To Whom and For What Purpose Do We Disclose Your Information? 

We may disclose Personal Information that we collect or you provide as described in this Privacy Notice to the following categories of third parties for the enumerated processing activities:

  • To our volunteers and partners, including our practicing attorney mentors, law school admissions counselors and LSAT tutors such as 7Sage, in order to provide counseling and other related services in connection with the Fellowship Program;
  • To our third-party service providers, including our Donations Processor, to provide website development, hosting, data storage, maintenance, donations processing, accounting, legal, advisory and other services for us;
  • To third parties as permitted or required to do so by applicable law or regulation, or in the good-faith belief that such action is necessary to take precautions against liability; to comply with various reporting obligations; to protect ourselves and our other users from fraudulent, abusive or unlawful uses or activity; to protect the security or integrity of the Site; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to comply with state and federal laws or in response to a court order, judicial or other government subpoena or warrant;
  • In any way we may describe to you when you provide such information, to fulfill any other purposes for which you provide such information or for any other purpose with your consent; or
  • If you direct us to do so.

Additionally, we may disclose aggregated information about our users, and information that cannot independently be used to identify any individual, without restriction.  

How Do We Protect User Information?

We use certain physical, managerial and technical safeguards that are designed to protect the integrity and security of your Personal Information; however, no security measures are perfect or impenetrable, so we cannot ensure or warrant the security of any information you transmit to us through the Site or in connection with the Fellowship Program, and you do so at your own risk. We also cannot guarantee that your information may not be accessed, disclosed, altered or destroyed by breach of any of our physical, technical or managerial safeguards.  We are not responsible for circumvention of any privacy settings or security measures contained on the Site.  Even after removal, copies of information that you have provided may remain viewable in cached and archived pages or in internal backups.

Our Commitment to Children and Minor’s Privacy

Protecting the privacy of young children and minors is especially important.  For that reason, we do not allow children or minors under 18 years of age to use the Site, we do not knowingly collect or maintain information from any persons under 18 years of age and no part of the Site is directed to persons under 18 years of age.  If you are under 18 years of age, then please do not use or access the Site at any time or in any manner.  

If you are a parent or guardian and discover that your child under 13 years of age has provided us with information, please alert us at info@fightingforfairness.org.

Visitors from Outside the United States:

This Site is controlled and operated by Fighting For Fairness in the United States.  If you choose to access the Site or apply to the Fellowship Program from outside the United States, you acknowledge that you will be transferring your information, including Personal Information, outside of those regions to the United States for storage and processing, as necessary to provide you the services available through the Site, including to process your Fellowship Application.  

Modifications to this Privacy Notice

We reserve the right at any time to modify this Privacy Notice.  If we make any material change to this Privacy Notice, we will post the updated Privacy Notice and indicate at the top of the Privacy Notice when it was last updated.  If you disagree with our Privacy Notice modifications, you may choose not to use or access our Site or Participate or withdraw Participation in the Fellowship Program.
